WEBSITE SALES TERMS & CONDITIONS
1. Definitions
Company
Means B&M Limited, operating as BM Supplies and bmsupplies.com.
Client
Means the person or company identified on the sales document, quotation, or order confirmation.
Goods
Means all products sold by the Company, including but not limited to tiles, sanitaryware, bathroom furniture, mixers, accessories, and related items.
2. General Conditions
- All quotations and orders are subject to these Terms & Conditions.
- No other terms apply unless agreed in writing and signed by an authorised representative of the Company.
- It is recommended that Tiles are installed on a layer of screed. If this is not done, the Client assumes full responsibility for any defects in laying or finish.
- Installation of any product constitutes acceptance of the goods.
- Website: Your computer may show outdated pages stored in its cache, so please refresh your browser to view current prices and available products.
- Security: We understand that online shopping is built on trust, so security is our top priority. Your credit card details are transmitted directly to the bank’s secure servers during the checkout process. No card information is stored on our systems or accessible to any member of staff.
- Our website uses GoDaddy Class 2 Certification to encrypt all data transmissions, providing independent verification that our secure server is authentic. At no point are your credit card details sent over an unsecured connection.
- Any offers or voucher promotions issued by B&M Limited may be used only on non-discounted items. Vouchers are not exchangeable for cash, and vouchers or discount codes cannot be redeemed during sale periods. Credit Notes, however, may be used during these periods.
- All pictures on our website are the best indication we can give of the original item and are for illustration purposes only. On occasion we may make small changes to the design of a product, due to this, the item/items you receive may have small differences to the picture displayed on the website. The colour of goods may vary slightly from that shown on the website due to limitations of browser software and monitors.
- All products are subject to stock availability at the time of ordering. While every effort will be made to ensure that all items shown are in stock we offer no guarantee of availability and this electronic publication does not constitute an offer of sale.
- All Prices stated include VAT At 18%
3. Quotations
- Quotations remain valid for 30 days unless otherwise stated.
- Prices quoted during SALE periods are valid only for the duration of the sale.
- Prices may change if suppliers adjust pricing or if the quotation expires.
4. Orders
4.1 Quantities
- The Client confirms that the quantities ordered are correct.
- The Company is not responsible for shortages or excess quantities.
- Additional tiles ordered later cannot be guaranteed to match the original tonality or calibre.
4.2 Amendments
- Changes to items or quantities after order placement may be accepted at the Company’s discretion.
4.3 Special Orders
- Non-stock, custom, or made-to-order items require full or partial prepayment and cannot be cancelled once ordered.
4.4 Payment
- All deliveries must be pre-paid in full before a delivery date is scheduled.
- Deposits are non-refundable once goods are ordered from suppliers.
4.5 Deliveries
- Delivery dates are estimates and not guaranteed.
- The Company reserves the right to make part deliveries.
- Delivery is door-to-door, ground floor only unless otherwise agreed.
4.6 Transport & Site Access
- The Client must ensure the site is accessible by truck.
- If hoisting or distribution to multiple areas is required, additional charges apply.
- The Client must organise permits and No Parking signs where required.
5. Claims
5.1 Shortages, Damages, Breakages
- Claims must be reported immediately during delivery to the delivery personnel.
- Damaged or short goods will be returned with the delivery team and noted on the delivery document.
- The Company will offer:
- A resupply of the same product, or
- A reorder, or
- A refund for the affected items.
5.2 Goods Collected from Store
- Goods must be inspected upon collection.
- No claims are accepted after goods leave the premises.
5.3 Defects
- All items must be checked before installation.
- No claims can be made on installed goods.
- Commercial-grade (KTL-Spain) or second-choice tiles are not eligible for defect claims.
6. Returns
6.1 Tiles
- No returns of extra tiles are accepted.
6.2 Custom Orders
- No returns of custom-made or special-order items.
6.3 Stock Items (Excluding Tiles)
- Stock items may be returned for a credit note within 2 months if unused and in original packaging.
7. Cancellations
7.1 Stock Items
- Orders may be cancelled any time prior to delivery. Refunds will be processed and documented through the issuance of a Credit Note.
7.2 Non-Stock Items
- Orders already produced or in transit cannot be cancelled.
- Deposits for such items are forfeited.
8. Storage
- The Company offers 2 months of free storage after the agreed delivery deadline.
- After this period, storage is charged at €60 per cubic metre per month (VAT included).
- If goods remain uncollected for an extended period (Six Months), the Company may resell them to recover costs.
9. Warranty
- Goods are warranted to comply with manufacturer standards.
- Warranty period: 24 months from delivery/collection unless otherwise specified.
9.1 Warranty Conditions
- Valid only upon presentation of the original invoice or cash sale.
- The Company may repair or replace items based on manufacturer instructions.
- Warranty does not cover:
- Incorrect installation
- Poor workmanship
- Incorrect water pressure
- Limescale damage
- Wear and tear
9.2 Liability
- The Company is not liable for:
- Consequential loss
- Labour costs
- Water damage caused by installation
- Project delays
10. Installation & Third-Party Works
- The Company does not provide installation unless explicitly contracted.
- The Company is not responsible for:
- Installer errors
- Incorrect measurements provided by the Client or installer
- Damage caused during installation
- Technical drawings are indicative and must be verified by the installer.
11. Data Protection
- Personal data is used for invoicing, statements, credit control, and internal analysis.
- Data is not sold or shared for marketing purposes.
- In cases of default, the Company may share information with legally entitled third parties.
- Data is processed in accordance with GDPR and Maltese law.
12. PRIVACY POLICY
Your privacy is important to us, and we understand how important it is to you. Our aim is to be as clear and transparent as possible about the information we collect and why we collect it.
All client information provided during the ordering or registration process is collected and stored lawfully and in accordance with applicable data protection legislation. All information held on our systems is password-protected. We do not use your information for marketing purposes without your consent. These terms and conditions do not affect your statutory rights.
